Abstract

The Judgment of the Court of Justice of the European Union (Grand Chamber) of 21 December 2016 has considered contrary to arts. 7, 8, 11 and 52.1 of the CFDUE any general and undifferentiated conservation regime of all traffic and location data of all subscribers and users in relation to all electronic means of communication. Hence, the regime established by Law 25/2007 on the retention of data relating to electronic communications and public communications networks is to be understood as contrary to the aforementioned rights of the CFDUE and consequently can not be assigned by court order to investigate the crimes under the provision contained in art. 588 ter j. LECRIM.
