Resumo
The determination of the connecting factor for concretizing the applicable Law to personal status has been historically discussed in Private International Law because of the existence of three possible criteria: nationality, domicile and habitual residence. The interest of the question has been recently renewed because of two reasons: the current idea of a multicultural approach to the application of family Law (which would be helped by the use of nationality, particularly in countries with high number of immigrants as is the case in Spain) and the development of an European community family Law (based on the use of habitual residence as an inclusive policy). In order to a possible reform, the Spanish Private International Law system can not ignore this new debate.
