Abstract
Penal Code was reformed to face the �broadcasting piracy�, penalizing as a crime some behaviours not very serious, that could be considered just as civil illicit or simple misdemeanours. The experience shows that although the collective interests have to be necessarily protected, all this must be always subjected to a strict control. Thus, it is appropriate to reaffi rm the relevance of the penal Law principles, perhaps old principles but in any way obsolete, as the unique way to prevent the repressive excesses, principles that lead to propose the immediate reform of article 286 CP.
