Resumo

Maternity cases by substitution or surrogate way (commonly called «wombs for rent») are being a true revolution in the field of assisted reproduction and a real legal challenge in terms of attribution of maternity and affiliation. The approach is simple and has two differentiable parameters of discussion: in the first place, if it is possible to make a private contract which stipulates that a woman is forced to gestate for the other one and, secondly, to determine if the son or daughter born by this method has a filiation («son of�») which belongs to the pregnant woman, the biological mother or the legal mother.
