Resumen

This paper examines the ways in which the European Union safeguards the non-discrimination principle as regards one’s disability, paying particular attention to the Council Directive 2000/78/EC of 27 November 2000 establishing a general framework for equal treatment in employment and occupation. The link between the notion of “obesity” and those of “disability” and “injury” motivates the analysis provided by EU case law and the innovations contained in a number of judgments from the European Court of Justice in relation to this terminology. The final aim is to assess whether dismissing obese workers might amount to discrimination.
