Abstract

The entry into force of Law 26/2015 has meant the incorporation in the Spanish Law of the so-called open adoption, under which the adopted child can maintain some form of relationship or contact with a member of his biological family, once the adoption is constituted. Nevertheless, the analysis of its legal regime evidences that the new Law requires a regulatory development that details the brief regulation on this point. The present work addresses the regulation of this modality of adoption in the United States and Great Britain, in order to contribute to a better understanding of such. Without losing sight of the principles of public order on which our Family Law is structured, there are certain aspects of the mentioned systems that can help when giving answers to the questions raised by the new Spanish legislation.
