Résumé

This chapter deals with an overview of the Convention of the United Nations Convention on the Use of Electronic Communications in International Contracts (New York, 2005), prepared by UNCITRAL (United Nations Commission on International Trade Law). The guiding criteria and principles of the Convention are examined. It highlights and analyzes the most important elements of its content such as the scope, the location of the «cyber operators», the time and place of dispatch and receipt of electronic communications, the contractual offer in «cyberspace», «automatic» agreement by electronic means, electronic agents and clicking error.
