The purpose of this essay consist on knowing the impact of the application of labor regulations to the franchise system, addressing from the perspective of judicial practice. The aim is to analyze the scope of the labor responsibility of the franchisor companies regarding to employers of the franchised company, as well as the social and labor responsibility of the companies involved in the transmission of a franchise contract, wich it is largely discussed at Courts of Justice. These controversials and complexes issues are usually solved through the application, in some terms or others, depending of the concurrent circumstances, of the labor regulation applicable to the mechanisms of productive decentralization, such as the illegal cession of workers, the group of companies or the succession of companies.This is a subject of great interest, overall for the repercussion of the response given to the assumptions made in order to determine the responsible company in the workplace. So that, the main question is what the paths to apply labour liability to companies of a franchise agreement, which it can be useful in order to answer the complex issues frequently raised at the Courts of Justice.
