Resumen

This paper pretends analyse the notion of collective intentionality and its differents aspects which many authors have criticized as flawed and inconsistent with methodological individualism attributed to Searle. Within this context we will tackle one of the most interesting parts of his theory: the background, conceived as a pre-intentional and non-representational state that enables us to 'cope' to the world. There are many ideas about the collective intentionality and it has become one of the most debated concepts in recent years in academic ground. We will present the most relevant criticisms that many authors have made to this concept. Finally, we will extend this discussion to the socio-legal field, looking for the normative dimension of collective intentionality and highlighting the importante of this concept for social and political theory
