The Supreme Court has pronounced, for the first time, on the new marriage or the marital cohabitation of the beneficiary spouse of the use of the family house with a third party, considering it as a cause of extinction of the attributed use. This pronouncement has given rise to positions in favor and against, a faithful reflection of the division that already existed in the doctrine and in the minor jurisprudence in this regard, especially when the use is attributed taking into consideration the higher interest of the common children under age, which may be left unattended.
