Abstract

In the case of a mortgage on an unregistered building, consider the common doctrine and jurisprudence that, for substantial reasons of accession, the mortgage is extended to the unregistered building, without the need for a new construction declaration, and without even needing the building to be mentioned in the mortgage deed. Faced with this position, the author of this work, with support in some jurisprudence (minority) and based on registration reasons, defends the need for the existing building to be declared and registered, or, at least, mentioned in the mortgage deed.
