Abstract
The free nature that is being recognized of the attribution of the use of the family house after the family crisis has led to situations of abuse and imbalance between the parties. It is proposed, therefore, de lege ferenda, a model similar to French or Portuguese, in which the house is attributed through the constitution of a forced lease in favor of one whose interest is most in need of protection
