Resum
Dans la période actuelle caractérisée par les fortes tensions entre un paradigme nationaliste et intolérant et l’idée même de « l’Union par le droit » prend une dimension centrale le principe de l’État de droit. Pour être configuré comme une règle de coexistence de la société européenne, ce principe doit être retravaillé dans la double direction de la tension dialectique avec les normes démocratiques, d’une part, et de la comparaison dialectique avec les «traditions constitutionnelles communes», d’autre part. Cet essai vise à analyser ces questions d’identité à l’aide de la nouvelle méthodologie de l’«écart ».
