Abstract

Forced marriage is a new crime in the Spanish Criminal Code since the 2015 reform. Doing so, Spain follows the same direction taken by European countries which, since the 2011 Istanbul Convention, decided to criminalize this behaviour. In this work we maintain that this crime is not justified in necessity but in another reason: stigmatizing the immigrant and certain cultural groups that carry out these harmful cultural practices. On the contrary, instead of this simple and easy punitive solution, a responsible society should face this problem with a broad social policy and not with symbolic Criminal Law measures
