Abstract

The collaborative economy has come to stay, leaving in its wake the traditional business models in which only two parties (the service provider and the user) intervened and bringing with it more complex relationships in which a third agent is involved: digital platforms. These platforms are born as mere intermediaries, connecting service providers with users, in order to facilitate transactions between both parties. However, in recent times, there are increasing assumptions in which such platforms cross the boundaries of intermediation, becoming decisively involved in the activities carried out by the service providers that hire them and this blurs their legal contours, making very difficult to define the responsibilities they must assume. This is the question that focuses the object of this study. In particular, we will try to clarify the role played by digital platforms that connect customers with suppliers, focusing above all on a particular sector, that of lodging for tourists
