Articles 108.4 and 116.2 of the Consolidated Text of the Law on Intellectual Property (hereinafter TRLPI), which correspond, in European Union law, with Article 8.2 of Directive 92/100 EEC and Article 8.2 of Directive 2006/115 provide [..._] the obligation of the user of a phonogram published for commercial purposes, or of a reproduction of such a phonogram, which is used for wireless broadcasting or for any communication to the public to pay a fair and one-off remuneration to performers and producers of phonograms, between whom it shall be distributed [..._].The question at issue in this case is whether the public communication of audiovisual works by a television channel generated the right to receive the single equitable remuneration provided for in the above-mentioned provisions. More specifically, what needed to be determined is whether once a phonogram has been published for commercial purposes, or a reproduction of such a phonogram has been incorporated into an audiovisual recording in which an audiovisual work is fixed, performers and producers of phonograms may demand remuneration. In those circumstances, the Supreme Court referred the following questions to the Court of Justice of the European Union (ECJ) for a preliminary ruling: first, whether the concept of reproduction for commercial purposes contained in art.8.2. of Directives 92/100 and 2006/115 includes the reproduction of a phonogram published for commercial purposes in an audiovisual recording containing an attachment of an audiovisual. Second: if the answer is in the affirmative, if it is obliged to pay such equitable and one-off remuneration as provided for in art. 8.2 of those Directives a television broadcaster using, for any type of communication to the public, an audiovisual recording containing the affixing of a cinematographic or audiovisual work in which a phonogram published for commercial purposes has been reproduced.
