Résumé
This paper analyses the Spanish Supreme Court Ruling of 18 July 2019 (RJ 2019/3471) with regard to a case of civil liability arising from a nosocomial infection contracted by a patient during his hospital stay at the UVI. The Court considers that these infections fall within the control of the hospital and, consequently, the responsibility of the centre can be agreed without the need to prove blame or negligence in the provision of the sevice.
