Abstract
In many instances Beccaria has been accused of plagiarize ideas exposed by other authors. Although this is partially true, there is no doubt that his merit for having synthesized a lot of these ideas in a short booklet, written in a simple and brilliant way, has manage to maintain its validity during two and a half centuries. Nonetheless, as far as the reasoning related to torture is concerned, the rejection that Bec-caria had to it is whole, without any reservation nor exception, and not only because of purely utilitarian reasons, but also because of justice and humanist motives.
