Abstract

The internationalisation of organised crime that has taken place in the late twentieth century as a result of globalisation was – and still is – one of the main concerns of inter-national institutions and governments today. In order to stem this development, the usual policy adopted is to make use of criminal law focusing mainly on the time-honoured offence of criminal association and the new offences of conspiracy and organised crime introduced by Organic Law 5/2010. In this paper we offer a critical analysis of each of these offences and then tackle the diffi-cult problem of compatibility between them in view of their similarity of purpose, as raised by the 2010 reform. Our aim is to help lawyers (as far as possible) deal with the complex issues posed by current legislation on this matter
