Abstract

The abuse of fixed-term employment contracts in Spain has caused a significant precariousness in the laboral market and great uncertainty about the hiring rules and their compliance with Community law. The continuous conflicts with Community law, having failed to achieve the objetives of Directive 1999/70/CE after 20 years since its transposition, have highlighted the urgent need to clearly determine its requirements and select the most appropriate measures to deal with the reform of structural temporary hiring (art. 15 ET), in order to reverse the current situation.
