Zusammenfassung
The author investigates the obstacles put by the state to the process of recognition and efficacy of the rights of cultural minorities. The state employs strategies to avoid the recognition of rights and, once this recognition is nevertheless obtained, it uses tactics to prevent its efficacy consisting of: a) the remission to norms of development that do not arrive or arrive late, b) the obstruction of its efficacy by the powers of the state, especially the executive power, and c) the limits to the exercise of rights that are subjected to the superior norms of state law and to the interpretation and even validation by state judges.
