Resum

In this Debate on Blockchain Technology, we start from the concept, nature, philosophy and inspiring principles of Smart Contracts, to ask six greats specialists in the field: What —exactly— are Smart Contracts? Is their nature —really— contractual or are they simple self-executing computer programs —with the imposition of conditions and possible compensation for non-compliance— without any contractual connotation? Do the miners or the oracle have any responsibility before the supervening and unexpected irruption of failures or evils of the system? What is the philosophy of this —alleged— intelligent contractual option that is established in an exclusively electronic habitat outside the Law? How smart are these contracts? What is the philosophy of Smart Contracts? And finally: Should they be regulated or can we assume without further ado —and outside the walls of the Law— nothing less than a whole Technology or chain of blocks consisting, in essence, of a large database made up of a book, catalog or electronic record — decentralized, distributed, immutable and built on the basis of consensus— where are each and every one of the digital actions or transactions carried out by its members, with their own language and currency?
