Resumo

Law 2/2023, of 20 February, transposes Directive (EU) 2019/1937, of 23 October 2019, on the protection of persons who report breaches of Union law. The rule that is the subject of analysis and interpretation in this article affects the field of labor relations from a double aspect. On the one hand, it establishes the business obligation to create and manage internal channels of information on serious and very serious crimes and administrative infractions. On the other hand, persons recognised as informants will enjoy a special status that should protect them against any type of retaliation, including in the workplace or professional, related to their activity as a whistleblower. As an instrument for controlling the proper functioning of the protection system, the new regulations create the Independent Whistleblower Protection Authority (AAI), which will be responsible for both the management of the external information channel and the application of the corresponding sanctioning regime. This paper will only address the typical labor aspects that the standard regulates, that is, the rights and obligations that, in each case, affect the labor relations system and the people, entities and organizations involved.
