Zusammenfassung

This work examines the legal framework governing religious assistance in public residential facilities intended to provide assistance to women who have experienced gender-based violence. Despite the importance of safeguarding religious freedom and its potential impact on the support provided to victims, especially women, adolescents and girls, this issue has received less attention and academic scrutiny in Spain than other essential social services such as health, legal, and psychological support. In addition, it should be noted that research on religious assistance has tended to focus on other public institutions, such as the military, prisons and hospitals, which are traditional subjects of study in our universities. The exposition is divided into two distinct sections, supported by both national and regional legislation, especially Andalusian legislation. The first section deals with the constitutional basis of the right to religious assistance, including its positive and negative concepts, holders, contents and limitations. The second part of the work focuses on the concept of gender-based violence, its typology, and the tools used by public authorities to provide protection and assistance to victims. It includes a description of residential facilities (crisis centres and shelter houses) and concludes with an overview of the proposal for the development of the religious assistance service model provided by legally recognised religious denominations, including those that have signed cooperation agreements with the State.
