Zusammenfassung
This paper analyses the social background and the main legal keys that led to the definitive elimination of the crime of blasphemy from the Irish legal system, following the holding of the corresponding referendum on constitutional reform in 2018. All of this is linked to the intense process of secularisation experienced in that country, as well as to the phenomenon of the gradual replacement of this type of offence by other rules that aspire to find a more appropriate balance between religious freedom and freedom of expression, which has been occurring especially in the European sphere.
